Privacy Policy

How Fingerscan Digital Inc collects, uses, and protects your information.

Last updated: [EFFECTIVE DATE — e.g. June 18, 2026]

Fingerscan Digital Inc (“Fingerscan Digital,” “we,” “us,” or “our”) provides fingerprinting, Live Scan, and background-check support services to employers, law firms, and licensing-regulated organizations from our office at 434 Blossom Hill Road, San Jose, CA 95123. This Privacy Policy explains what information we collect through this website and in the course of providing our services, how we use and share it, and the choices and rights you have.

Because our services involve fingerprints and government background checks, this policy describes how we handle sensitive information, including biometric data. Please read it carefully.

1. Who this policy covers

This policy applies to:

  • Website visitors who browse fingerscan-digital.com or submit a form;
  • Clients — the employers, firms, and organizations that engage our services; and
  • Applicants — the individuals whose fingerprints we capture and whose background-check information we process at the request of a client or agency.

2. Information we collect

Information you give us

When you contact us, request a quote, or set up an account, we collect the details you provide — such as your name, organization, email address, phone number, and the contents of your message.

Information we collect to perform our services

To complete a fingerprinting or background-check request, we and the government agencies we submit to require identifying information about the applicant, which may include full name, date of birth, address, government-issued identification details, and the Social Security number and other fields required on the applicable Request for Live Scan Service form or fingerprint card. We collect this information directly from the applicant, or from the client or agency that requested the service.

Information collected automatically

When you use our website, we (and our service providers) may automatically collect technical information such as your IP address, browser and device type, pages viewed, and referring page, through cookies and similar technologies. See Cookies & website analytics.

3. Fingerprints & biometric data

Fingerprints are sensitive biometric information, and we treat them accordingly.

  • We capture fingerprints only to perform the Live Scan or fingerprint-card service that you, your employer, or a licensing agency requested.
  • For electronic (Live Scan) submissions, fingerprint data is transmitted to the California Department of Justice (DOJ) and, where required, the Federal Bureau of Investigation (FBI) to conduct the authorized background check. For ink fingerprint cards, the completed card is provided to you or mailed to the agency you designate.
  • We do not sell biometric information, and we do not use fingerprints for any purpose other than the requested service and as required by law.
  • Handling and retention of fingerprint and background-check data are governed by the requirements of the DOJ, the FBI, and applicable law. [CONFIRM your retention practice — e.g., “Fingerprint images are transmitted for processing and are not retained by us after submission,” or state your actual retention period.]

4. How we use information

We use the information we collect to:

  • Provide the fingerprinting and background-check services requested, including submitting fingerprints and identifying information to the DOJ and/or FBI;
  • Return results or completed cards to the authorized recipient (you, your employer, or the requesting agency);
  • Respond to inquiries, prepare quotes, schedule appointments, and manage accounts and billing;
  • Operate, secure, and improve our website; and
  • Comply with our legal, regulatory, and contractual obligations.

5. How we share information

We share information only as needed to provide our services and as permitted or required by law:

  • Government agencies. We transmit fingerprints and required identifying information to the California DOJ and/or FBI to process the authorized background check.
  • The authorized recipient. Background-check results and confirmations are provided to the party entitled to receive them — typically the employer, firm, or licensing agency that requested the check, or the applicant.
  • Service providers. We use trusted vendors to operate our business — for example, website hosting, form processing, and payment handling — who may process information on our behalf under confidentiality obligations. [CONFIRM/UPDATE the list of providers you actually use, e.g., hosting, form, payment, reviews.]
  • Legal and safety. We may disclose information when required by law, subpoena, or legal process, or to protect our rights, safety, or property.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

6. Cookies & website analytics

Our website uses cookies and similar technologies to operate the site, remember preferences, and understand how visitors use our pages so we can improve them. Some pages may include third-party content — such as an embedded map or a reviews widget — that can set its own cookies. [CONFIRM the specific tools you use, e.g., Google Analytics, Google Maps, Trustindex.] You can control cookies through your browser settings; disabling some cookies may affect how the site works.

7. Data retention

We retain personal information for as long as needed to provide our services, maintain business and accounting records, and comply with our legal obligations, after which we securely dispose of it. Fingerprint and background-check data are handled in accordance with DOJ, FBI, and applicable legal requirements. [CONFIRM your specific retention periods where you are able to state them.]

8. How we protect information

We maintain reasonable administrative, technical, and physical safeguards designed to protect the information in our care against unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

9. Your California privacy rights

Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), California residents have rights regarding their personal information, including the right to:

  • Know what personal information we collect, use, and disclose;
  • Request access to, or a copy of, that information;
  • Request correction of inaccurate information;
  • Request deletion of personal information, subject to legal exceptions;
  • Limit the use and disclosure of sensitive personal information; and
  • Not receive discriminatory treatment for exercising these rights.

Because we do not sell or share personal information for cross-context behavioral advertising, no opt-out of sale or sharing is necessary. Please note that certain information — including fingerprints and background-check data submitted to government agencies, or records we are legally required to keep — may be exempt from deletion or otherwise subject to retention under law.

To exercise a right, contact us using the details in Contact us. We will verify your request before responding and will respond within the timeframes required by law. You may use an authorized agent to submit a request on your behalf.

10. Children’s privacy

Our website and services are directed to businesses and adults, not to children. We do not knowingly collect personal information from children through this website. Where fingerprinting is performed in connection with a minor as part of a licensing or program requirement, it is done at the direction of, and with the authorization of, the requesting organization, agency, parent, or guardian.

11. Third-party links

Our website may link to other sites, including our sister site and partner organizations. We are not responsible for the privacy practices of websites we do not operate, and we encourage you to review their privacy policies.

12. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above. Material changes will be reflected on this page, and your continued use of our website or services after an update means you accept the revised policy.
