For a licensed facility, a clearance gap is not paperwork — it is a survey deficiency and a daily fine. Each risk below names the rule and the consequence.
A non-cleared person present in the facility
If a person works, resides, or is present before a criminal-record clearance or exemption, the licensee is cited for a deficiency and assessed civil penalties of $100 per violation per day. The clearance has to precede the first shift.
A home care aide working before registry clearance
An affiliated home care aide must pass a Live Scan check and be listed on the Home Care Aide Registry before providing services. An unregistered aide in the field is an agency compliance exposure on audit.
A name-based check used instead of Live Scan
A name-based or database-only check does not satisfy Community Care Licensing. The clearance is fingerprint-based, submitted by Live Scan to the DOJ and FBI, and tied to the requesting facility — a name match is not accepted.
A clinical hire who cannot show clearance
Licensing and renewal for many clinical roles typically require Live Scan. A hire who cannot evidence a clearance may not be credentialed or cleared to start — confirm the exact requirement with the board.
