In short

A single status affidavit is a notarized statement that you’re legally free to marry. To use it abroad — in Mexico, the Philippines, Vietnam, and most countries — it must be apostilled by the California Secretary of State. Living outside the U.S.? We can assist with your single status document, including the apostille, and ship it to you, so you never fly home for paperwork.

What it is

What is a single status affidavit, and why apostille it?

A single status affidavit is a sworn, notarized statement that you are legally free to marry. Foreign governments ask U.S. citizens for it before a wedding abroad, because U.S. records don’t prove marital status the way many countries expect.

A notarized affidavit alone carries no weight overseas. The registry needs proof that the notary is real, so it gets a single status affidavit apostille — an authentication added by the California Secretary of State apostille office under the Hague Convention, accepted abroad without an embassy step.

We handle the full chain in San Jose: prepare or review the affidavit, notarize it, add a certified translation if needed, and return it apostilled — so nothing is rejected at the registry.

How it works

Four steps from affidavit
to apostilled and ready

1

Notarize your single status affidavit

Bring a valid government ID to our San Jose office. We prepare or review your single status affidavit and notarize it with a bonded California notary — in English, Spanish, or Vietnamese.

2

Add a certified translation if needed

If your country requires the affidavit in its official language, we coordinate a certified translation and keep it paired with your original so the apostille covers both.

3

Apostille by the California Secretary of State

We submit the notarized affidavit for the California Secretary of State apostille. Choose standard, priority, rush, or same-day depending on your deadline.

4

Pick up or ship your apostilled affidavit

Collect it in San Jose the same day on rush service, or we ship it tracked to you or directly to the foreign registry so it arrives ready to use.

Overseas and asked to prove
you’re free to marry? We handle it here

You don’t need to fly back to California. We can assist with your single status document, including the apostille, from our San Jose office, then ship it tracked to you or straight to the registry.

1

Send your details and the registry’s checklist

Call or email your full name, date of birth, a passport copy, and the exact wording the registry abroad asks for.

2

We prepare your document and the apostille

We handle your single status document and submit it to the California Secretary of State at the apostille tier you choose.

3

Tracked delivery wherever you are

Your apostilled document ships internationally with tracking, so you can register the marriage without a trip home.

Is this the right document for you?

It fits best if you lived in Santa Clara County before moving abroad. Lived or married somewhere else? Call first, and we’ll tell you honestly which document your country accepts before you pay anything.

If the registry insists on a sworn statement signed abroad, you sign it at a U.S. embassy or consulate and it then needs a federal apostille, which we also handle.

Common questions

Single status affidavit apostille
questions, answered straight

Can you get my single status document if I live outside the U.S.?
Yes. Overseas clients are a big part of what we do. Send us your details and the registry’s checklist, and we can assist with your single status document, including the apostille, then ship it to you with tracking. No trip back to California needed.
How much does a single status affidavit apostille cost?
The single status document is $150, plus the California Secretary of State apostille tier you choose: Standard $85, Priority $200, Rush $350, or Same-Day $450. Translation and international shipping are quoted before you pay.
Will a Santa Clara County single status letter work in my country?
Many registries accept it, especially if you lived in Santa Clara County before moving abroad. Some insist on a sworn statement instead. Send us the registry’s written requirement and we’ll confirm the right document before you pay.
How long does it take to get it apostilled and shipped abroad?
Preparing your single status document takes a few business days. The apostille then takes from same-day to about 30 days, depending on the tier you choose. International delivery time varies by country, and you get a tracking number the day it ships. Tell us your wedding date and we’ll plan backward from it.
The registry abroad wants a specific wording. Can you match it?
Yes, and you should ask for it. Registries differ on what the affidavit must state — some want parents’ names, some want the intended spouse named, some want a specific declaration of capacity to marry. Get their requirement in writing and bring it in. A generic affidavit apostilles perfectly well and is then refused there for missing a line.
How recent does it need to be?
This one matters more than most. Many registries treat a single status affidavit as valid for only three or six months, because it is a statement about your present circumstances. Sign it close to the wedding date rather than months ahead, and check the accepted age with the registry before ordering.
Do I need a divorce decree as well?
Often, if you were previously married. Many registries want the apostilled divorce decree alongside the affidavit to prove the earlier marriage ended. Our divorce decree apostille page covers that, and we handle both together so the dates align.
Do I need a translation, and in what order?
Usually yes for a foreign registry. The order is fixed: notarize, apostille, then translate — a translation attached before the seal is not covered by it. Some countries require a translator registered there rather than here, so ask the registry before paying.
