What is a POA apostille

Why your power of attorney
needs a Hague seal

Quinnie Do explaining the power of attorney apostille process at her San Jose office

The walk-in POA apostille California path

A power of attorney lets someone you trust act on your behalf — sell property, manage finances, settle inheritance, sign contracts. To use that authority abroad, the document needs an apostille: the state-level Hague seal from the California Secretary of State that makes a U.S. notarized document legally valid in over 120 countries.

Our clients need apostilles for property closings in Mexico and Spain, banking in India and China, inheritance in Korea and the Philippines, business in UAE and Brazil — we apostille power of attorney for Mexico transactions just as readily as Indian or Korean cases. Our in-office partner, TruPoint Legal, drafts it at your direction; we notarize on-site, translate into 100+ languages, and submit to the California Secretary of State for the seal. That’s the full POA apostille California workflow.

Most clients also need to notarize and apostille power of attorney in one visit — one office, one visit, no chasing three vendors.

Common POA apostille use cases

Most-served situations
What our clients need

Whether you need to apostille power of attorney for Mexico real estate, Indian succession, or any of 120+ Hague countries, here are the most common reasons clients seek one.

Real Estate

Property closings abroad

Selling a Cancun condo, buying in San Miguel, transferring a Madrid apartment. Foreign notarios require an apostilled POA so a representative can sign without you flying overseas.

Inheritance

Estates & succession overseas

A relative passed abroad — in Mexico, India, Korea, or the Philippines. Apostille for Mexico filings, Indian succession, and Korean estate matters all require authorized representation for court, bank, and property transfers.

Banking

Foreign accounts & investments

Closing a foreign bank account, restructuring NRI investments, signing on a Korean CD — banks require a notarized, apostilled, translated POA matching their compliance template.

Property Trusts

Fideicomiso & foreign trust changes

If you hold a Mexican fideicomiso (bank trust on coastal property) or any equivalent foreign trust, modifications require an apostilled POA drafted to the trustee’s template.

Common questions

POA apostille questions
answered straight

How long does power of attorney apostille San Jose service take?
Depends on the tier. Standard ~30 days, expedited ~2 weeks, rush 3–5 business days. Same-day available when you submit before 10 AM — we hand back the apostilled POA by 6 PM. Most Mexico-bound clients pick rush or same-day.
Do you translate POAs into languages other than Spanish?
Yes. We translate into 100+ languages — Korean, Mandarin, Hindi, Arabic, Vietnamese, Tagalog, Portuguese, French, German, Russian, Japanese, and many more. Bilingual English/Spanish POAs for Mexico are prepared by our in-office partner, TruPoint Legal. Translation is $75 per document under 250 words, plus $50 if notary certification is required.
What types of POA do you apostille?
All of them. General, durable, special (limited), financial, healthcare, and revocation POAs. Real estate, banking, inheritance/succession, fideicomiso modifications, business signings — if it’s a notarized power of attorney, we apostille it.
Can I bring my own POA, or can someone prepare it for me?
Either way. If you have a draft — from your attorney, a Mexican notario template, or a bank’s compliance form — bring it. If you don’t, our in-office partner TruPoint Legal, a registered Legal Document Assistant, prepares it at your direction for $200, and we notarize ($15 per signature) and apostille it in the same visit.
Will my power of attorney apostille Mexico (or any Hague country) work?
Yes. Mexico, India, South Korea, Spain, Italy, Brazil, the Philippines, China, Vietnam and the other 130 Hague members all accept an apostille issued by the California Secretary of State. The UAE is not a member, so documents going there follow the longer consular route instead. A Mexico apostille request, for example, satisfies the federal authentication requirement — foreign notarios then process per local law. No embassy legalization needed.
What about UAE, China, Korea, or India?
Not all the same. India and South Korea are Hague members, and China joined in 2023, so an apostille suffices for those three. The UAE is not a Hague member — a POA going there needs the longer consular chain ending in embassy legalization, and an apostille alone will be refused. We handle either route, but the difference matters, so tell us the destination before anything is drafted. Translation requirements vary too, so confirm those with the recipient.
Can a notary apostille a document?
No. A notary witnesses your signature; only the California Secretary of State can attach the apostille to a California-notarized document. That is why the two steps are separate, and why we do both here: our commissioned notary takes the signature and we file the apostille for you, so you make one trip instead of two.
Do you offer mobile notary for POA apostille?
Yes — for clients who can’t come to Blossom Hill Rd, mobile notary is available across Santa Clara County and the South Bay starting at $175. Call ahead so we can match the right notary to your bilingual or document-handling needs.
What does same-day POA apostille rush actually cost?
All-in same-day — covers on-site notary, expedited handling, and tracked return. submit before 10 AM and we hand back the apostilled POA by 6 PM. After 10 AM, we drop to rush service available with 3–5 business day return. The seal is identical at every speed — you are paying for the calendar, not a better document.
My POA was refused overseas even though it had an apostille. Why?
Because the apostille and the document are two different things. The apostille proves the notary’s signature is genuine; it says nothing about whether the POA grants the authority the receiving office needs. A generic form apostilles perfectly well and is then refused abroad for missing a specific power. The apostille was valid — the document was not.
How do I find out what the POA has to say?
Ask the office that will act on it — the notario, lawyer, bank or registry — to tell you in writing what powers it must grant. That one email saves more time than any service tier we sell, because it is the difference between one visit and three. Bring their wording in, and our in-office partner TruPoint Legal prepares the POA around it.
Can I sign it at home and bring it in?
No. A power of attorney must be signed in front of the notary — that is what the notary is attesting to. A document signed beforehand cannot be notarized, and without notarization it cannot be apostilled. Bring it unsigned, with photo ID.
Can you come to me? The signer is in hospital or cannot travel.
Yes, mobile notary covers Santa Clara County and the South Bay from $175. The signer must be conscious, able to understand what they are signing and able to communicate that willingly — a notary cannot take a signature otherwise, and we will say so honestly rather than take the booking.
Does a POA expire?
The apostille does not, but the POA itself may — either because you wrote an end date into it or because the receiving country treats powers of attorney as valid for a limited period. Some registries abroad also want one issued recently. Ask before you assume an older POA is still usable.
Can I cancel a power of attorney after it is apostilled?
Generally yes, by revoking it, but how a revocation must be delivered and recorded depends on where it is being used — and that is a legal question rather than a document one. We are not attorneys and cannot advise on it. Speak to a lawyer in the country where the POA is operating.
Do I need a translation, and in what order?
It depends on the destination. Where one is required the order is fixed: notarize, apostille, then translate — a translation attached before the seal is not covered by it. Some countries also require a translator registered there rather than here, so ask the receiving office before paying for either.
Which tier do I actually need?
Tell us the date the transaction closes or the office needs it, and we will name the cheapest tier that still makes it. If the closing is months out, the standard tier is the right answer and we will say so rather than sell you same-day.
